On June 15, 2012, Department of Homeland Security (DHS) Secretary Janet Napolitano issued a memorandum regarding exercising prosecutorial discretion with respect to individuals who came to the United States as children.

 

The memorandum directs DHS component agencies such as Customs and Border Patrol (CBP), Immigration and Customs Enforcement (ICE) and the US Citizenship and Immigration Services (USCIS) to exercise prosecutorial discretion, on an individual basis, by deferring action for individuals who meet the following criteria:

New Rule Changes to Form I-601 Will Unify Families Faster

On January 6, 2012, the U.S. Citizenship & Immigration Service (USCIS) announced a proposed change to the waiver of inadmissiblity, Form I-601, which is normally filed after an immigrant has departed the United States.  The proposed change will instead allow the immigrant to apply for this waiver before departing the United States.  The proposed change is aimed to help immediate relatives (spouses and children of U.S. citizens) avoid long processing delays in their home countries, thereby reuniting families sooner.  The
